1. Introduction

Welcome to RequestFX, a service provided by Fifth Axiom d.o.o. ("we," "us," or "our"), a company registered in Slovenia.

By creating an account, accessing our Web Platform, or downloading our Chrome Extension (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.

2. Definitions

  • "Service" refers to the RequestFX Web Platform, the RequestFX Chrome Extension, and any related API services.
  • "User Content" refers to any documents, questionnaires, knowledge base assets, or text that you upload, input, or process using the Service.
  • "Output" refers to the text, answers, or data generated by our AI models based on your User Content.

3. Account Registration and Security

  1. Eligibility: You must be at least 18 years old and capable of forming a binding contract to use the Service.
  2. Account Security: You are responsible for maintaining the confidentiality of your login credentials (username and password). You are fully responsible for all activities that occur under your account.
  3. Accuracy: You agree to provide accurate and complete information during registration and to keep this information up to date.

4. Use of the RequestFX Web Platform

  1. Access Rights: We grant you a non-exclusive, non-transferable, revocable right to access and use the RequestFX Web Platform via a standard web browser solely for your internal business purposes.
  2. Core Functionality: The Web Platform constitutes the primary service offering. It enables you to manage projects, upload and index knowledge base documents, parse vendor questionnaires, and generate AI-driven responses.
  3. Platform Availability: While we strive to ensure the Web Platform is available 24/7, we do not guarantee uninterrupted access. We reserve the right to modify, suspend, or discontinue any part of the Web Platform with or without notice for maintenance or updates.

5. Use of the Chrome Extension (Optional)

  1. Supplementary Nature: The RequestFX Chrome Extension is an optional accessory designed to enable users to solve web-based questionnaires directly within their browser. It is not required to use the core features of RequestFX.
  2. License: If you choose to install the Extension, we grant you a limited, non-exclusive, revocable license to use it in conjunction with your Web Platform account.
  3. Permissions: You acknowledge that the Extension requires specific browser permissions to function. You agree not to tamper with or exploit these permissions for unauthorized data access.

6. User Content and Intellectual Property

  1. Your Ownership & Control: You retain all ownership rights to the User Content you upload (e.g., your RFPs, security policies, and knowledge base). We claim no ownership over your proprietary data. You have full control over your data and may permanently delete your User Content from our systems at any time.
  2. Limited License to Us: By uploading User Content, you grant Fifth Axiom d.o.o. a worldwide, royalty-free license to host, copy, parse, and process that content solely for the purpose of providing the Service to you (e.g., to generate answers).
  3. No AI Training Guarantee: We strictly represent and warrant that your User Content will NOT be used to train, retrain, or improve our artificial intelligence models or the models of our third-party providers. Your data remains isolated and is used strictly to generate outputs for your specific account.
  4. Our IP: The RequestFX platform, including its code, design, algorithms, logos, and the "RequestFX" brand, is the exclusive property of Fifth Axiom d.o.o. You may not copy, modify, or reverse engineer any part of the Service.

7. AI Disclaimer and Liability (Critical)

RequestFX utilizes Artificial Intelligence (AI) and Large Language Models (LLMs) to assist in answering questionnaires.

  1. Accuracy Warning: AI models can make mistakes, "hallucinate" facts, or misinterpret questions. RequestFX is a productivity tool, not a replacement for professional legal or security advice.
  2. User Responsibility: You are solely responsible for reviewing, verifying, and editing all Output generated by the Service before submitting it to any third party (e.g., a vendor or client).
  3. No Warranty: We make no warranties regarding the accuracy, completeness, or suitability of the AI-generated Output. Fifth Axiom d.o.o. shall not be liable for any errors, omissions, or damages resulting from the use of unverified AI Output.

8. Acceptable Use

You agree NOT to:

  • Use the Service for any unlawful purpose or in violation of any local, state, or international law.
  • Reverse engineer, decompile, or attempt to extract the source code of the Service.
  • Use the Service to generate or process content that is illegal, harmful, threatening, or sexually explicit.
  • Share your account credentials with multiple individuals (unless part of a specific Team plan).
  • Interfere with or disrupt the integrity or performance of the Service (e.g., DDoS attacks).

9. Third-Party Services

The Service relies on third-party infrastructure (e.g., Google Cloud, Firebase) and AI providers. You acknowledge that:

  1. Availability: We cannot guarantee 100% uptime if these third-party providers experience outages.
  2. Links: The Service may contain links to third-party websites. We are not responsible for the content or practices of these external sites.

10. Payment and Subscription

  1. Fees: Certain features of the Service may require a paid subscription. You agree to pay all applicable fees in accordance with the pricing terms presented at the time of purchase.
  2. Changes: We reserve the right to change our pricing or subscription models. We will provide notice of any price changes in advance.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, FIFTH AXIOM D.O.O. DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FIFTH AXIOM D.O.O. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY.

13. Indemnification

You agree to indemnify and hold harmless Fifth Axiom d.o.o., its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including legal fees) arising out of your violation of these Terms or your use of the Service (including any User Content you submit).

14. Termination

We reserve the right to suspend or terminate your access to the Service at our sole discretion, without prior notice, for any reason, including but not limited to a breach of these Terms. Upon termination, your right to use the Service will immediately cease.

15. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Republic of Slovenia, without regard to its conflict of law provisions. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts in Ljubljana, Slovenia.

16. Changes to These Terms

We may update these Terms from time to time. We will notify you of any significant changes by posting the new Terms on this page and updating the "Last Updated" date. Your continued use of the Service after such changes constitutes your acceptance of the new Terms.
